Yes, plus certain species are federally protected/managed and the states cannot preempt those regulations.

Additionally, just about all the states abide by the NOAA/NMFS harvest/bio stock guidelines. Basically these guidelines set harvest limits and its up to the states to figure out how to get within guideline. For example in NY, the summer flounder (fluke) fishery was "over harvested" in 2016, by "x" amount. NY is this now mandated to reduce the harvest and it can do so in a number of ways, including lowering the bag limit, increasing size to retain, limiting the open season. Usually, to not drastically impact the fishery, it's a combination of all 3. For 2017, the fluke size limit went up by an inch, bag limit dropped from 5 per man to 3 per man and the season decreased by a couple weeks. Overall it's not bad. Honestly I don't mind regulations and firmly believe they are necessary.

I hate to say this, but left to the discretion of the individual, the ocean would get pillaged of its resources. With proper management and education, we can enjoy the oceans bounty and preserve it for the future.
