I have the following question:

I had a wrongly named party in a case in CA. There are two defendants. Plaintiffs attorney agreed to dismiss them without prejudice. We signed a SOL tolling agreement in which plaintiff stated that Plaintiff agrees to dismiss them from the lawsuit without prejudice.

Do Plaintiffs counsel need to do anything else like amending complaint or file a notice to dismiss party without prejudice?

When I answer the complaint should I answer on behalf of the defendant that is left only?

Thanks Appreciate answers

I would have plaintiff file a request for dismissal (form CIV-110), and note in section 1(b)(6) that he is dismissing these particular defendants.
