Let’s talk trial skills. I was talking to a senior trial attorney at my firm today (no joke, he actually tries cases, like 2-3 civil PI trials a year).

In any case, I rattled off a few of the heavy hitter plaintiffs’ personal injury lawyers here in our neck of the woods and went through each one. I asked, what makes them (there was one we focused on who has less than 15 years and more than $200,000,000.00 in verdict money) successful. He said bottom line: personality. That’s it. Sure preparation and some intelligence matters but it’s personality.

So my point. Do you agree? What kind of personality is it? Not to take this into the dome sphere but is it the same kind of guy (I’m not being sexist here but all th lawyers we mentioned were men) that could talk a dog off a meat truck?

You can’t coach speed, right? So where do you plateau with this skill set?

From my understanding most top performance(top 2-5) in skilled competition are just pure talent while the people below them (5-25%) are neurotic overachievers.

The best trial lawyers I have been exposed to are just innately fearless. That's most definitely a personality trait. Within the fearless group, the means and method of preparing and winning are as individual as the attorneys themselves.

That's why a firm or public defender that expects everybody to try x number of cases a year are short changing themselves and their clients.The trial unit should do trials. Those who work well with the mentally ill and drug addicted should do the specialty courts. Those who like to research and write should do motion work and appeals. Etc. Everybody has their talents that should be capitalized on.
