The ABA just recently adopted a new amendment ABA model rules 8.4(g)... i am not sure what states have adopted it or if it would run against the 1st amendment but here it is--

"It is professional misconduct for a lawyer to:

(g) engage in conduct that the lawyer knows or reasonably should know is harassment or discrimination on the basis of race, sex, religion, national origin, ethnicity, disability, age, sexual orientation, gender identity, marital status or socioeconomic status in conduct related to the practice of law. This paragraph does not limit the ability of a lawyer to accept, decline or withdraw from a representation in accordance with Rule 1.16. This paragraph does not preclude legitimate advice or advocacy consistent with these Rules."

It is completely ABSURD to claim antisemitism because the general public condemned this guy’s bigoted remarks.

It is ironic for a jew (persecuted people) to be this racist against another group (who have done nothing to him). And suggesting antisemitism is also very ironic.

But in this absurd age of identity politics, in the scramble to identity as a victim, who knows how the next incident will manifest itself. Personally I think the guy exhibits the traits of a person with a personality disorder.

The reason we're hearing about this is sensationalism. News outlets are attempting to stir-up people's emotions for ratings, so they're jumping on this story.

To most people (especially in a place like New York), this type of conduct is unacceptable. We don't need CNN reminding us of this.

National news doesn’t look for what is most newsworthy at this point. The best stories are the ones that are the most inflammatory. To be clear - this guy seems like a total jerk and a lousy person. But the response has been a little over the top. One news outlet contacted his past and present clients “seeking comment” and the identified the clients by name in an article - meaning if within 48 hours these clients don’t fire this guy and hire a new lawyer, they are aiding and abetting a known racist. This, the news has ensured that this guy’s career and ability to earn a living is totally over. That might be a bit extreme for 30 seconds of terrible/awful behavior. I’m not condoning what this jerk did - I’m just not sure a life sentence is the correct punishment.

Absolutely, you have to be so very careful what you say and do anywhere outside of your house now because someone is always sitting there with a camera and recording. You cant even yell at people in traffic anymore because someone with a dash cam or gopro will e-mail the video to your employer.

I think it’s an interesting story because of all the contradictions and irony. A racist Jew. A dude who promotes himself as speaking Spanish attacking two women for speaking Spanish. A customer at a hippy-dippy salad joint is racist. An attorney who should know that it’s wrong to berate someone simply because of their nationality or language does just that. A Jew who supports Trump. A guy going off on people for being “foreign” in the middle of a city that celebrates diversity. Accusing people who are actually working of leaching off the welfare system. I could go on...

I worked with him at one of his former law firms. Never had a clue he had mental issues, but some of my colleagues on Facebook who remember him allege he has massive anger management issues. There are also videos of him yelling at a Trump rally/protest (calling other Jews “fake Jews” and insulting a NYC tourist on a sidewalk (calling him an “ugly foreigner”). There is a FB video of a Mexican Mariachi band serenading oitside his building on the Upper West Side. The guy will have a hard time getting his career back on track. Eventhe ALT RIGHT wont want him.

Although I think Mr. Schlossberg is a rude idiot (and many other things probably), I don't feel comfortable with the media-induced lynching and I have been witness to far more racist tirades on the subway (to name an example) but of course, Blacks saying awful things to tourists like "go back to yourcountry you (homophobic expletive) " doesn't go viral and even if someone had the guts to film them, the national news media would most likely not jump on it as much.

Is this guy an asshole? YES. Does that warrant following him everywhere, paying a visit to HIS PARENT's house? I mean c´mon. By all means, don't do business with him if you are a client, your choice...but this response is extreme. I agree with what notiers above has said. Publishing the names of clients, protesting outside his house...that's something you see in Soviet Russia or Cuba...not in a country that allegedly says people have a right to their ideas, no matter how odious...having a right to them also means being left alone (im not saying he shouldnt be fired or called out...just not in this extreme way)

And then we had the spectacle of elected officials trying to decide who should or should not practice law.


When race-speak (by the way this guy mentioned language, not race...but the press IMMEDIATELY branded him a "racist"...being against languages is not the same thing as being against a race, but OK, anyway when black or latino activists say racially charged things (or anyone with a beleaguered skin hue) ranting against "white privilege", we are quick to defend them...but that doesn't apply for white racists when they whine about how welfare types, those low wage workers who speak Spanish and not English amongst us, are unworthy of the humanity that their skin color doesn't warrant apparently.

The chorus of "outrage" and manufactured boos demanding conformity of thought and sanitized racial viewpoints are scarier than the rants of some single, sad and apparently not in good mental health shape random lawyer.

One thing is his opinion that people should speak English (an opinion to which he is entitled to have). The other is him verbally harassing both the customer and restaurant employee. Keep in mind that the Spanish speaking customer was not some low wage employee. Speaking Spanish does not equate being on welfare.

Don't confuse the two. They are not the same thing. And a politician talking about white privilege is not the same. It's not a direct verbal attack against a random person on the street.

Right, Spanish speaking doesn't mean being on welfare any more than being White equal automatically privileged or racist, etc. There is nothing to confuse here: he's an idiot for verbally attacking random people, but the news media went ballistic over something we can witness almost any day in NYC (not racist comments specifically, but certainly people being nasty to each other).

I've never had anyone threatened to call U.S. Immigration and Customs Enforcement (ICE) on me though. . . .

If you are talking about the fact that a White person is not presumed to be an illegal alien, I get your point...but the fact is ICE does exist and yeah, they do deport illegal immigrants but they also don't take any random call and would probably go after this Schlossberg guy for abuse/misuse of their # (assuming he really would call).

I won't answer your comment about Harlem because now you are trying to put words in my mouth with random scenarios. You want to turn this into a discussion about privilege and go off on a tangent. I will stay on topic.

Just as if someone were to call the police to say that their neighbor's house is being broken into, there is a good chance ICE might come down to the business to investigate if called. ICE is known for doing employment raids.

What Schlossberg did was more than be rude. It rises above that level. It is harassment. Harassment is a crime in NYC. The U.S. Congressman was correct in reporting him to the First Department Disciplinary Committee in NYS. Schlossberg will at least get some type of official reprimand (public or private) especially since this is not the first time Schlossberg has done something like this.

When lawyers commit crimes (of various types), the media finds this especially newsworthy. Guide yourselves accordingly fellow attorneys.

Sure, a White person won't be presumed to be an illegal (but they can be presumed to be other things by a racist). I only mentioned the Harlem scenario because it is real and raw racism. Not into turning this into a discussion on privilege.

If whatever AS did is illegal, by all means let him be reprimanded, prosecuted, whatever. I don't really find his comments all that newsworthy to go on and on for days.

PS: I'm being generous in conceding you on the illegal alien point...since AS doesn't even seem all that White to me...or to put it another way, if I were racially profiling for immigrants, I'd stop him for papers. We can all agree he is insane.

I agree, he really should've known better. We should ask ourselves a broader question though: should a person be literally run out of public life and town for incidents of asshole behavior? I'm not talking about individual reactions, but I have never seen this level of retribution in my life for instances of rude behavior. Not even China, a totalitarian state, would've gone on full lynch mode like the American media has done. Completely lynch a man who just ranted that he wasn't happy people were speaking a foreign language.

This is pure mob justice and I'm sure some in the crowd would've been delighted to have an excuse to stone him and smash his head in -- there were literally dozens of comments of people saying they wanted to beat him up.

Meanwhile, you have ELECTED POLITICIANS or running for office openly saying VERY RACIST things...like Donald Trump saying African countries are "sholes" and no real outrage. You have a politician in Texas saying he didn't want his daughter marrying interracially...the reaction is no where near this manufactured outrage against AS...with politicians even now asking to disbar him. I mean you have security guards at his building former place of work saying, quote: "We want to bury him alive"...I mean HOLY S how screwed up is the US as a country?
