I'm not in the office so I can't look at our doc bank. But I'm curious why you would want to do this? I don't think I've ever seen Respondent's attorney make this type of motion.

The reason is: My client has a prior deportation order 1996 and DHS wants to reinstate.By terminating proceedings the old Deportation order need to get enforced.Now, I can request Reasonable fear interview with IJ but I would like to oppose their motion in case the IJ doesn’t find my client to be reasonably afraid and he will get deported.
Any suggestion will be appreciated.The reason he came back after the deportation order in 1996 is that he was shot 8 times after returning to ES and is blind with one eye now.
