I needed an attorney to help me sue my current insurance company for damages to my roof from hurricane Harvey 2017.
Received a settlement and just need to sign the papers to close the case and dismiss my attorney. My problem is, that before I hired this attorney I was already receiving payments for the interior damage from the hurricane. The insurance company agreed to pay for the construction and items replaced only for the interior damages. I was waiting for my final payment when the insurance company settled my case for the roof. When my attorneys bill came along with the final paperwork I noticed in the misc column was my check I had been waiting for $2,312.27. My attorney kept it and stated it was part of his fee. I provided a letter from my insurance company telling him exactly what that money was for, but since it had my name, my husbands name and the attorneys name he decided it was his. The check has his name on it also because when we hired him, our insurance company could no longer communicate with us. All correspondence had to go to the attorney.
Is there something I’m missing?? And why won’t he give it to me?

He can't cash the check until you sign it. You need to look at your fee agreement or ask him how much you owe him.

keep in mind that the #1 reason for disbarment/suspension is financial malfeasance. If that amount exceeds what's in your fee agreement, threaten to file a bar complaint (and even if he does give it back, file the complaint anyway - we don't want scum like that ripping people off)
