Termination notice (roommate)

I currently sublease a room to a roommate who has decided to stop paying me. I spoke with an attorney and I have to first file a notice of termination. This is a 3 story owner occupied house in NYC. My lease does say no subleasing allowed, BUT the landlady has known I do this anyway and she hasn't had a problem with it. Lease expires November 30 and she has no problem with me staying after. She sympathizes with me in this matter. My question: do I have to evict him or does the landlady? Also, can the termination notice say anything about him not using MY personal property in the apartment? I blocked him from wifi (since the only written agreement we have only says that he pays a weekly amount until his monthly rent is covered for the room -- this is signed by him). I do not guarantee him any non-essential service, nor do I allow him to use my property (all under my name with receipts to prove it) in the kitchen.

Any thoughts are appreciated.

How does your state/city define “Tennant?”
