In contrast to Gibraltar, Malta, Switzerland, and other international jurisdictions, the United States Congress did not pass legislation that regulates digital currencies and digital assets. Instead, the United States relies on the Howey test in its analysis of whether a digital asset is securitized.

As a result, there will be gaps with respect to the regulation of securitized assets. In other words, some will fall through the cracks. Why the lackadaisical response to a large, albeit shrinking, market? The US should regulate this market as it regulates other markets. Instead, it applies archaic rules so the wild west can take over.
