According to the statement of claims, Avenatti handled litigation with an unnamed third party for Barela, securing him a confidential settlement. In January 2018, according to Barela’s claim, the third party started paying funds into a client trust account managed by Avenatti for him to pass to Barela. But instead of doing so, Avenatti allegedly told Barela the third party never paid the settlement money. As the months passed, Barela’s suit says, he grew increasingly anxious about the money, frequently asking Avenatti when it would come through.

As part of our investigation, we contacted the lawyer for the settling party and he gave us a copy of the unaltered settlement agreement and the wire-transfer confirmation showing that his client made the settlement payment to the bank account specified by Mr. Avenatti five days before it was due.

Rule number 1 of being an attorney is don’t f*** with your IOLTA account. Rule number 2 of being attorney is don’t f*** with your client’s money. Everything else is forgivable.

Maybe, but isn't CA notoriously slow, even with egregious cases? It seems like all the CA disbarment cases I've read were (e.g.) 2012 or 2015 decisions based on conduct from (e.g.) 2004 or 2007.

Damn, I guess this broke too late for All the President’s Lawyers to tackle it.

I wonder, if true, what caused him to get in over his head that forced him to delay payments to Peter to pay Paul.

“Ken, you’re a professional trial attorney, is the issue here just that Rudy Giuliani is smarter than us...?”

“The Germans have an expression, too clever is dumb...if Rudy is smarter than us, he’s smarter in such a way that we cannot perceive it and therefore it is not effective.”

“Is Michael Avenatti a good lawyer?”

“Well he is still technically a lawyer”

“If you had to hire [Avenatti or Giuliani] as your lawyer, who would you go with?”

“The death penalty”

Three genuine laugh out loud moments

If I were a plaintiff in a products liability case or serious personal injury case, I’d take Avenatti. If I had some sort of New York City zoning/land use case where connections are important, I’d take Giuliani. In every other situation, I’m defending myself.

On May 7, 2018, Barela wrote that if the company "does not pay soon," he might "need a little help" financially from Avenatti. On May 15, Barela again asked if the company had "respond[ed] or paid." Barela also noted in one conversation that he was planning to host a watch party at his home for an upcoming Avenatti appearance on "60 Minutes."

After several advances of funds from Avenatti, on Oct. 10, 2018, Barela wrote, "I was hoping to have an update" on the settlement funds and "get our money." He tells Avenatti, "I need 8K by Tuesday or I'm in deep sh**," and on Oct. 22, he emailed a dire assessment.

Assuming these texts and emails are not fabricated, Avenatti is in deep doo-doo.

Who is Avenatti? Is he related to this "Hillary" person people are always whining about?

What is the conservative interest in Mr. Avenatti at this point, who is not a candidate for any office? If they can discredit Mr. Avenatti, does that mean that Trump did not pay off a porn star in violation of campaign finance laws? It seems neither here nor there.

Cons don't actually care about the ethics, they just want to collect an anti-trump scalp. Avenatti deserves to be scalped though, so bygones.

he said at some point that he might run for president. Even though literally no one thinks that's a good idea and he has zero support, the conservatives must discredit him just in case. Its why they keep talking about Hillary, just in case she runs again. Also, they think he's some kind of liberal hero for some reason, so they think it makes us sad when bad things happen to him.

Clearly if they're bringing up Mr. Avenatti, they must be right wing.

They have a lot of stories on Scty. Clinton, too - seals the deal right there, I tell ya.
